JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 16-09-2025 Heard learned senior counsel for the petitioner, learned senior counsel for the informant and learned APP for the State.
2. The petitioner is apprehending his arrest in Rupaspur P.S. Case No. 622 of 2024 registered under Sections 126(2), 115(2), 118(1), 109 of the BNS, 2023 and 27 of the Arms Act.
3. The informant makes allegation that when he was going to his house, co-accused Ramesh Sinha along with this petitioner started firing on his vehicle. He suffered pillet injury and was shifted to the hospital.
4. Learned senior counsel for the petitioner has submitted that the injury report issued by Danapur Hospital where the

No.9926 of 2025(4) dt.16-09-2025 2/3 patient was first treated, does not contain signature of the doctor who examined the informant and the injury report issued by the PMCH shows that the informant did not receive any kind of fire arm injury. It has further been submitted that as a matter of fact, the informant had prepared a videograph of sister of the petitioner and he was misusing that videograph and in that respect, the sister of the petitioner had lodged a case 20 days prior to the present occurrence. The father of the petitioner has also lodged a case against the informant, in which, he has stated that the informant along with some unknown persons came to his house and started pelting stones and in order to save his life, he opened fired by his gun.

On the other hand, learned senior counsel for the informant has submitted that from PMCH, the petitioner was referred to a private hospital and the doctors of the private hospital found fire arm injury on the person of the informant. Learned senior counsel also submits that the informant remained under treatment in that private hospital for 20 days.
6. According to the injury report issued by the first hospital, although the petitioner suffered fire arm injury but there is no signature of doctor thereon. The doctors of PMCH specifically mentioned in the injury report that there is no fire
Patna High Court CR. MISC. No.9926 of 2025(4) dt.16-09-2025 3/3 arm injury on the person of the informant. Twenty days prior to the present occurrence, the sister of the petitioner had lodged a case against the informant for preparing a videograph and making that video viral on social media.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-2nd, Danapur in connection with Rupaspur P.S. Case No. 622 of 2024, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ 482(2) of the BNSS, 2023.
