2. As prayed for, learned senior counsel is permitted to make necessary correction in paragraph no. 1 regarding provisions of law, during the course of the day itself.

3. The accused/petitioners are named in F.I.R. and apprehending their arrest in connection with G.R. No. 2287 of 2024 arising out of Birpur P.S. Case No. 115 of 2024 registered for the offences punishable under Section 366A of

Patna High Court CR. MISC. No. 5906 of 2025(2) dt.15-02-2025 2/3 the Indian Penal Code.

4. The allegation against above named petitioners is to kidnap the daughter of the informant alongwith co-accused persons/family members with intention to force or seduce her for illicit intercourse with another person.

Ms. Archana Sinha, learned senior counsel appearing on behalf of the petitioners submitted that petitioners are maternal uncle and aunties and just on the basis of suspicion they were implicated with present case, which alleged to be taken place on 30.05.2024. It is further submitted by learned senior counsel that FIR in issue was lodged after five days of the occurrence, where the thrust of allegation is available against co-accused Deepak Kumar. Petitioners are said to be a man of clean antecedents, where petitioner nos. 2 and 3 are ladies.

6. Learned APP opposed the prayer of bail.

7. Considering the aforesaid facts and circumstances and by taking note of fact as the above named petitioners are maternal uncle and aunties of the main coaccused Deepak Kumar, out of which they appears implicated

No. 5906 of 2025(2) dt.15-02-2025 3/3 prima facie with present occurrence, where FIR in issue appears to be lodged after five days of the occurrence, coupled with fact that petitioners are of clean antecedents, where petitioner nos. 2 and 3 are ladies, accordingly, all above named petitioners, in the event of their arrest or surrender before the learned trial Court, within a period of four weeks of the order, are directed to be released on bail furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Cum Addl. Magistrate, Begusarai/concerned Court, where the case is pending in connection with G.R. No. 2287 of 2024 arising out of Birpur P.S. Case No. 115 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C./482(2) of the BNSS.
