The petitioner is languishing in jail custody since 18.03.2015 in connection with Katihar Town P.S. Case No. 151/2015 for offences alleged under Sections 25 (1-B) A, 26 of the Arms Act.

The prosecution story is that on 16.03.2015 while the informant, who is Assistant Sub Inspector in Nagar Thana, Katihar was making a raid in another case he came to know by one of the dreaded criminal that the petitioner is the main assistant of a criminal, namely, Raman Paswan. On that information the very next day in 17.03.2015 while the informant with other policeman were patrolling, he saw a boy was going by

When the informant enquired about him, he started to flee away but with the help of another policeman, the informant managed to catch him. It is further alleged that the boy disclosed his name as Ravi Kumar Jaiswal (petitioner) and on search a country made pistol loaded with four cartridges were recovered from his trouser.

It has been submitted by learned counsel for the petitioner that the petitioner has clean antecedent and he has been falsely implicated in the aforesaid case. He has further submits that he has no concern with the seized arms.

In view of the facts and circumstances, let the petitioner, namely, Ravi Kumar Jaiswal be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Katihar Town P. S. Case No. 151/2015.
