The petitioner apprehends his arrest in connection with Kasba P.S. Case No. 203 of 2019 registered under Sections 323, 341, 324, 307, 504, 34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to local politics and ulterior motive. Further submission is that petitioner has no criminal antecedent.

Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner by contending that in the F.I.R., there is specific allegation against the

Patna High Court CR. MISC. No.4410 of 2020(3) dt.01-07-2020 2/2 petitioner of dragger blow on the vital part of the niece of the informant with intention to kill him and the injury is also corroborated with the alleged allegation. Hence, this is not a fit case for anticipatory bail.

Having considered the facts and circumstances of the case and the submission of the learned counsel for the State, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer of the petitioner for grant of anticipatory bail is rejected. (Arvind Srivastava, J) shailendra/- U T
