Petitioner seeks regular bail in connection with Patrakar Nagar PS Case No. No. 473 of 2022 dated 10.08.2022 registered under Section 356, 379, 411 of the IPC. As per the FIR based upon the written report of the informant, the informant was proceeding towards Rajendra Nagar Railway Station from Sandalpur, Kumhrar where he was intercepted by two persons sitting on a motorcycle and after snatching his mobile both persons fled away. Upon alarm being raised by the informant several persons assembled over there, caught the accused persons, informed the local Patrakar Nagar Police Station and one mobile phone of the brand 1+ was

Patna High Court CR. MISC. No.8107 of 2023(2) dt.10-05-2023 2/3 recovered from the petitioner. It has further been alleged that several mobiles were recovered from both the persons. Learned counsel for the petitioner submits that petitioner has got no criminal antecedent and he has falsely been implicated in this case on the basis of a concocted story. The petitioner was also going to catch the train but due to some scuffle with the informant he has been dragged in the present case. From perusal of the FIR only one mobile phone has been recovered from the possession of the petitioner but the seizure list discloses that four mobile phones were recovered from the petitioner's possession. The petitioner is in custody since 11.08.2022 and charge sheet has already been submitted.

Regard being had to the submission made by the parties, taking into consideration the material on record, the fact that petitioner has got no criminal antecedent, he is in custody since 11.08.2022, charge sheet has already been submitted, there is no likelihood that the petitioner will abscond or tamper with the evidence if released on bail, I am inclined to grant regular bail to the petitioner.

Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10000/- (rupees ten thousand) with two sureties of the like amount each to the
