JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 12-08-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Motihari Town P.S. Case No.340 of 2013 registered for the offences punishable under sections 363, 366A and 120B read with 34 of the Indian Penal Code.

The prayer for bail of the petitioner was earlier rejected by this Court with liberty that if the trial is not concluded within six months from the date of framing of charge, he may renew his prayer for bail.

It is contended that charges were framed on 8.12.2014

Patna High Court Cr.Misc. No.36434 of 2015 (2) dt.12-08-2015 2/2 but till date no witness has been examined on behalf of the prosecution during trial. The petitioner is reported to be in custody since 31.1.2014.

Regard being had to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Motihari at East Champaran in connection with Motihari Town P.S. Case No.340 of 2013 corresponding to Sessions Trial No.702 of 2014. (Ashwani Kumar Singh, J) Md.S./- U T
