The petitioner seeks bail in Sessions Trial No.123 of 2017/ 148 of 2017 arising out of Daudnagar P.S. case No.04 of 2016 registered under Sections 147, 148, 149, 302 of the Indian Penal Code, pending in the court of 1st Additional Sessions Judge, Aurangabad.

The earlier bail application of the petitioner was rejected vide Annexure 1 series to the present application taking into account that specific injury has been attributed against the petitioner.

A report was called for from the court below regarding the stage of trial. It has been reported that all the prosecution witnesses have already been examined and the case

Patna High Court CR. MISC. No.8533 of 2019(3) dt.17-07-2019 2/2 is fixed for argument and the trial is expected to be concluded within a period of four months.

It has been submitted on behalf of the petitioner that an application was filed on behalf of the informant under Section 294 of Cr.P.C. for getting certain documents exhibited. Said application was rejected by the trial court and against that order the informant preferred an application in the Hon'ble High Court. No interim order has been passed by the Hon'ble High Court on the said application filed by the informant. Considering the nature of accusation and the stage of the trial, I am not inclined to grant bail to the petitioner. The same is rejected.

The Trial Court is directed to take all necessary steps to conclude the trial at the earliest preferably within a period of four months from the date of receipt/production of a copy of this order, taking note of the submissions as advanced on behalf of the petitioner.
