In this case, the petitioner is apprehending his arrest in connection with Sonpur (Hajipur) Rail P.S. Case No. 69 of 2019 registered for offences under sections 379 of the Indian Penal Code.
As per prosecution case, the Informant was going to Gorakhpur from Hajipur through Sampark Kranti Express. When the train started to move, someone snatched his mobile and alighted from the train. Thereafter, the Informant alighted from the train at Sonpur Station and instituted the F.I.R. The Police has recovered the mobile phone from one Prince Kr. who informed the police that he has purchased the same from the present petitioner.
Patna High Court CR. MISC. No.5378 of 2020(2) dt.29-02-2020 2/2 Learned counsel for the petitioner submits that the mobile has not been recovered from the conscious possession of the petitioner. He further submits that the petitioner has got no criminal antecedent.
Looking to the entire facts and circumstances of the case, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.
Accordingly, the prayer for bail of the petitioner, above named, is rejected.
