The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 447, 504 & 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioners in furtherance of common intention are said to have come to the house of the informant and with intent to commit murder resorted firing upon the informant. It is submitted by learned counsel for the petitioners that no such occurrence as alleged ever took place.

The allegation levelled against the petitioners is not specific rather general and omnibus in nature. As a matter of fact, both the parties are close agnates and several disputes are going on between the parties. It is further submitted that the story of firing is seemed to be highly impossible because informant of the case who himself owner of the gun and the firing was made by the informant and with collusion of police the informant has filed this false and frivolous case. Petitioners have no criminal antecedent as mentioned in para-3 of this application.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with Kesariya P.S. Case No.320 of 2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Anjani Kumar Sharan, J) Trivedi/- U T
