JUSTICE ARVIND SRIVASTAVA ORAL ORDER 31-01-2022 Learned counsel for the petitioners seeks permission to withdraw the application of petitioner no.1 (Shiv Yadav) since he has been arrested during pendency of the application. Permission is accorded.
The application of petitioner no.1 (Shiv Yadav) is, accordingly, dismissed as withdrawn.
Heard both sides.
Petitioner nos.2 and 3 apprehend their arrest in Pandarak P.S. Case No.65 of 2020 registered under Sections 304B/201/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.16781 of 2021(6) dt.31-01-2022 2/2 petitioners have committed no offence and have falsely been implicated in this case. It is further submitted that there is no specific allegation against the petitioners. The petitioners are brothers of the husband of the deceased. The husband of the deceased is in custody.
Having considered the above facts and circumstances of the case, petitioner nos.2 and 3, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing personal bonds to the satisfaction of learned A.C.J.M., Barh, Patna in connection with Pandarak P.S. Case No.65 of 2020, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. Harish/- (Arvind Srivastava, J) U T
