Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. There is accusation against the petitioner that he hurled abusive language to informant naming her caste and also assaulted the informant's father with butt of pistol as well as tangi causing injury on his leg.

The injury report of informant's father reveals that one injury on knee joint of right leg was found grievous in nature but submission on behalf of the petitioner is that the aforesaid injury is attributed towards co-accused, Vinay Yadav, Rajesh Yadav and Chandrika Yadav, who have already been granted

Patna High Court Cr.Misc. No.32583 of 2015 (3) dt.20-08-2015 2/2 privilege of anticipatory bail by a co-ordinate Bench of this court vide order dated 28.07.2015 passed in Cr. Misc. No. 28303 of 2015 whereas petitioner is languishing in jail custody since 20.06.2015.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with S.C./S.T. P.S. Case No. 10 of 2015.
