JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-04-2019 This is an application for grant of anticipatory bail in connection with Nautan P.S. Case No. 367 of 2018, disclosing offences under Sections 147, 149, 341, 323, 324, 307, 504, 506 and 379 of the Indian Penal Code.
Allegation against the petitioner no.1 is of order giver, allegation against petitioner no.2 is of assault to one Mukesh Kumar by farsa and allegation against petitioner no.3 is of assault to the informant.
Submission of learned counsel for the petitioners is that there is land dispute between the parties and the decree has been passed in favour of the petitioners and due to that the present occurrence took place and there is counter case filed by
Patna High Court CR. MISC. No.9482 of 2019(3) dt.24-04-2019 2/2 the petitioners also and all the injuries are simple in nature except one injury on the person of the injured for which he had been referred to P.M.C.H, but he has been discharged from there.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand ) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran, Bettiah in connection with Nautan P.S. Case No. 367 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
