The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 323, 379, 498A and 504/34 of the Indian Penal Code.

It is a case of cruelty due to non-fulfilment of dowry demand of Rs.50,000/- and one motorcycle.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the petitioner has denied the solemnized the marriage with the complainant, namely, Rinki Devi and no apparent proof has been filed on behalf of the complainant in

Patna High Court CR. MISC. No.6464 of 2020(7) dt.24-02-2022 2/2 respect of the marriage. He further submits that the complainant has already married with one Vindya Choupal in the year 2014. Petitioner has got clean antecedent.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Saharsa in connection with Complaint Case No. 1200C of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
