Even if fardbeyan of the informant assumed to be true, then also, it was co-accused who committed theft and subsequently, from the possession of the petitioner mobile set is said to have been recovered, though petitioner flatly denied the aforesaid recovery. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in Araria P.S. Case no. 249/2015.
