The petitioner seeks bail in connection with Special POCSO Case No. 46 of 2019, arising out of Barh P.S. Case No. 132 of 2019 dated 12.03.2019 instituted for the offences under Sections 370, 376(A)(B) of the Indian Penal Code, Sections 4 and 6 of the POCSO Act and Sections 3, 4, 5, 6 and 7 of Immoral Traffic Prevention Act.

The prayer for bail of the petitioner was earlier rejected vide order dated 18.09.2019 passed in Cr. Misc. No. 40269 of 2019.

On 28.07.2021, this Court had called for a report about the stage of the case from the court below.

Patna High Court CR. MISC. No.16660 of 2021(3) dt.01-09-2021 2/2 The report indicates that all the witnesses except one have been examined and there is every likelihood of the trial being finally concluded within one month. In view of the matter, I am not inclined to entertain this application.

Accordingly, the prayer for bail is rejected. However, the trial court is directed to positively conclude the trial within a period of three months, failing which the petitioner shall be at liberty to approach this Court again for grant of bail.
