2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 25(1-b)a, 26, 35 of Arms Act.

3. It is alleged that this petitioner along with two other accused persons was driving the motorcycle recklessly but when the informant along with other patrolling officials stopped them, the accused persons tried to flee away in which one co-accused Neeraj Kumar Sardar, carrying firearms, was apprehended on the spot.

4. Learned counsel for the petitioner submits that petitioner has been made accused only on confessional statement of co-accused Neeraj Kumar Sardar who was

Patna High Court CR. MISC. No.11532 of 2024(2) dt.22-02-2024 2/2 apprehended on the spot with firearms and motorcycle. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent.

5. Considering the nature of accusation, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Supaul in connection with Triveniganj P. S. Case No. 288 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
