The matter has been taken up through video conferencing.

The petitioner seeks bail in Pothia P.S. case No. 218 of 2015 registered under Section 379, 414 of the Indian Penal Code.

The FIR was been registered against unknown for theft of electric wire against the owner, the driver and the cleaner of the vehicle bearing registration No. WB59A-9240 as the electric wire was found loaded on that vehicle. During the course of investigation the petitioner was apprehended and it is disclosed that petitioner is cleaner of the vehicle. The learned counsel for the petitioner submits that

The petitioner is in custody since 05.12.2019. The petitioner has already remained in jail for six months. Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj in connection with Pothia P.S. case No. 218 of 2015.
