JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-08-2015 Heard learned counsel for petitioner and learned Additional Public Prosecutor for the State. Petitioner is not named but in course of investigation, his involvement was found in the present case. The trial of the petitioner is in progress. The petitioner has a chequered history and in my view, if petitioner is released on bail, the trial of this case may hamper.

Learned counsel for the petitioner submits that having more or less similar allegation, one co-accused, namely Chandan Mishra has already been granted privilege of bail by a coordinate bench but taking note of the abovesaid facts as well as criminal antecedent of the petitioner, I

Patna High Court Cr.Misc. No.35079 of 2015 (2) dt.25-08-2015 2/2 do not feel it proper to release the petitioner on bail and accordingly, his prayer for bail in connection with Session Trial No. 153 of 2013 arising out of Buxar Town P.S. Case No. 133 of 2011 pending in the court of Sri U. K. Upadhyay, Learned Additional Sessions Judge-VI, Buxar stands rejected.

However, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible.
