The petitioner apprehends his arrest in a Complaint Case No.697 of 2014, registered for the offences punishable under Sections 498A, Indian Penal Code and 4 of the Dowry Prohibition Act.

The wife made specific allegation that petitioner subjected her to physical and mental torture due to non-fulfilment of demand of dowry.

Learned counsel for the petitioners submits that his wife had fled away with one Md. Sikandar. The wife is ready to live with her husband. Learned counsel for the petitioner further submits that he is also ready to keep his wife. Considering the facts aforesaid, the petitioner is directed to surrender in the court below within four weeks and the court

Patna High Court Cr.Misc. No.34760 of 2014 (2) dt.23-02-2015 below shall enlarge the petitioner on provisional bail, after issuing notice to the complainant, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Nawadah in connection with Complaint Case No.697 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and the court below shall make efforts for reconciliation between the husband and wife. If the dispute is resolved, the provisional bail granted to the petitioner shall be confirmed and if the dispute does not resolve the court below shall pass order in accordance with law.
