JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 26.02.2016 in a case registered under section 365 and 366 of the Indian Penal Code. The statement of the victim has been recorded under section 164 of the Cr.P.C in which she stated that she along with the petitioner on a motorcycle had gone to Samastipur where the petitioner boarded her on a train but in the meantime, when she got down from the train at Begusarai Railway Station to take water, other F.I.R named accused persons came there and forcibly took her for prostitution. She specifically stated that the petitioner was not at fault.

Accordingly, let the petitioner, above named, be

Patna High Court Cr.Misc. No.23924 of 2016 (3) dt.13-07-2016 2/2 released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IV, Darbhanga in connection with Moro P.S.Case No. 25 of 2013.
