2. The District Programme Officer (Establishment) is directed to call upon both the wives of the deceased employee and decide the entitlement on the basis of the records relating to the deceased employee. The factum of legal marriage and void marriage is concerned, he may verify from the record of the deceased employee whether pursuant to the decree of divorce, a consent was granted by the concerned Department to the deceased employee during his service period to perform marriage and accordingly decide the claim of the petitioner.

3. The District Programme Officer (Establishment)

Patna High Court CWJC No.2622 of 2023(3) dt.31-07-2023 2/2 must ensure to release all the other retiral dues relating to the deceased employee in accordance with law and distribute it among the legal heirs of the deceased employee, who according to the Court, are biological son(s) and daughter(s) of the deceased employee, in the equal share.
