2. The petitioners seek bail in connection with Warisnagar P.S. Case No. 169/2023 registered for the offence punishable under Sections 363/364/504 of the Indian Penal Code. Later on, Sections 302/201was added.
3. As per the prosecution case, the whereabouts of the victim has not disclosed to the informant. Subsequently, it has come that the victim was killed and cremated by the accused persons. The petitioners are the father-in-law and the mother-inlaw and the husband of the victim. During investigation, the remains of the victim has been recovered from an agriculture
Patna High Court CR. MISC. No.11150 of 2024(3) dt.18-04-2024 2/2 field near the house of the petitioner. They are in jail since 18.05.2023.
4. The petitioners are in custody since 18.05.2023
5. Considering the entirety of the facts, this application is allowed only against petitioner No. 1 and petitioner No. 2, who are the father-in-law and mother-in-law of the deceased and they are aged about 74-72 years.
6. So far as petitioner No. 3 who is the husband of the deceased is concerned, considering his role in the crime, this application against him (Petitioner No. 3) is dismissed.
7. Considering the period of custody, let the petitioner No. 1 and petitioner No. 2 except petitioner No. 3 be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Warisnagar P.S. Case No. 169/2023.
