The petitioner has prayed for regular bail in a case instituted for the offence under Sections 30(a), 32(i)(ii), 36, 41(i) of the Bihar Prohibition and Excise Act. As per prosecution case, on receiving secret information that co-accused Chunnu Thakur and his associates were coming with illicit foreign liquor by truck and he was coming to escort with his car. The police party stopped the vehicle and two persons were caught, they disclosed their names

Patna High Court CR. MISC. No.6213 of 2023(2) dt.02-05-2023 2/3 as Ravi Kumar @ Ravi Sahni @ Ravi Master (petitioner) and co-accused Amit Chaudhary and also disclosed name of persons who fled away as co-accused Chunnu Thakur, Truck driver, Rohit Kumar and Prince Kumar. On search, there been recovery of 1857.6 liters of illegal foreign liquor from a Truck, Bearing No. MH-434-8862.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He has committed no offence. Petitioner has no concern either with the seized vehicle/truck or with the wine in question rather seized vehicle, in which petitioner was sitting belongs to co-accused Amit Chaudhary. He is languishing in judicial custody since 22.10.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Court No. 2, Muzaffarpur in connection with
