JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-01-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are in jail custody since 09.06.2014 in a case registered for the offences punishable under Section 307 and other minor Sections of the Indian Penal Code as well as 27 of the Arms Act.
The specific allegation against petitioner no. 1 is that he gave dagger blow to informant's son but Annexure-5, the photostat copy of injury report of injured, Babloo Kumar, reveals that he sustained only one injury, said to be caused by hard and blunt substance that is too simple in nature. So far as allegation of setting the house of informant on fire is concerned, admittedly, after completion of investigation, the police submitted charge
Patna High Court Cr.Misc. No.34184 of 2014 (3) dt.23-01-2015 sheet under Sections 147, 148, 149, 341, 323, 379 and 435 of the Indian Penal Code.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also keeping in mind that a counter case has also been lodged on behalf of the petitioners, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Minapur P.S. Case No. 234 of 2014. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
