JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-11-2022 The present writ petition has been filed seeking the following reliefs:- "1.(i) For issuance of a direction to the respondent No. 5, the Circle Officer, Sampatchak and respondent No. 7, the Officer-in-charge, Parsa Bazar Police Station, District-Patna for removing the encroachment made by anti-social elements of the public road/government land.

(ii) For issuance of a direction to remove the encroachment made by the respondent authority within stipulated period fixed by this Hon'ble Court bearing Khata No. 721 situated in front of the

Patna High Court CWJC No.1941 of 2022(2) dt.11-11-2022 2/2 petitioner's land and several person moving and using for the purpose of moving on the main road. The aforesaid rasta is 110 feet wide the anti-social elements have blocked this aam rasta."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Sampatchak, District-Patna, for redressal of his aforesaid grievance.

Liberty so sought is granted.

It is needless to state that in case the petitioner approaches the Circle Officer, Sampatchak, District-Patna, by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the same shall be considered, in accordance with law and after hearing the affected parties, appropriate orders shall be passed thereon, forthwith.

The writ petition stands disposed off on the aforesaid terms.
