Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272,273 of IPC and Sections 30(a),36 of Bihar Prohibition and Excise Act. Liquor was recovered from the house of the petitioner. Submission is that the petitioner has got no criminal antecedent and the house is occupied by other family members also.

The petitioner is only accused in this case.

Considering the nature of allegation and the fact that the prayer for anticipatory bail is barred under Bihar Prohibition

Patna High Court CR. MISC. No.16749 of 2021(2) dt.23-11-2021 2/2 and Excise Act, I am not inclined to enlarge the petitioner on anticipatory bail in connection with Ahiyapur P.S.Case No.482 of 2020 pending in the court of learned Special Judge, Excise, Muzaffarpur. Hence, prayer is refused.

Petitioner is directed to surrender and pray for regular bail within two weeks.
