JUSTICE MOHIT KUMAR SHAH ORAL ORDER 27-02-2020 The short prayer of the petitioner is that now since the petitioner has already filed an objection under Section 9 of the Bihar and Orissa Public Demands Recovery Act, 1914, before the District Certificate Officer, Munger in Certificate Case No. 35 of 2017-18, the District Certificate Officer, Munger be directed to consider the same and pass final orders under Section 10 of the Bihar and Orissa Public Demands Recovery Act, 1914.

The learned counsel appearing for the State does not have any objection, however, submits that appropriate directions

Patna High Court CWJC No.3029 of 2020(2) dt.27-02-2020 2/2 be issued to the District Certificate Officer, Munger pertaining to passing of final orders under Section 10 of the Bihar and Orissa Public Demands Recovery Act, 1914.

Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the parties, I deem it fit and proper to dispose of the present writ petition with a direction to the District Certificate Officer, Munger to consider the objection already filed by the petitioner under Section 9 of the Bihar and Orissa Public Demands Recovery Act, 1914 and pass a final order under Section 10 of the Bihar and Orissa Public Demands Recovery Act, 1914 within a period of six weeks from today. It is needless to state that till passing of the final orders under Section 10 of the Bihar and Orissa Public Demands Recovery Act, 1914, no coercive steps shall be taken against the petitioner.

The writ petition stands disposed of on the aforesaid terms.
