The petitioner seeks bail in Banmankhi P.S. Case No. 55 of 2011 registered under section307 and other allied sections of the Indian Penal Code and 27 of the Arms Act.

Informant is the police officer, who named Jamal Mian and others and alleged that when the police went to raid the house the miscreants fired.

Learned counsel for the petitioner submits that petitioner Karim Mian is not named in the first information report and nothing has been recovered from the possession of the petitioner. Name of the petitioner figured in the confessional statement of co-accused Jamal Mian . Petitioner is in jail since

Patna High Court Cr.Misc. No.34874 of 2014 (3) dt.19-01-2015 2/2 18.06.2014. Jamal Mian and two others have already been enlarged on bail.

Having considered that the name of the petitioner figured in the confessional statement of co-accused, Jamal Mian , the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in Banmankhi P.S. Case No. 55 of 2011.
