JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-02-2019 Petitioners apprehend their arrest in connection with Parsa P.S. Case No. 141 of 2017 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 302 of the Indian Penal Code and 27 of the Arms Act.

Allegation as per FIR is that the accused persons, including the petitioners came variously armed and specific allegation against Shailendra Rai and Sahdeo Rai is of firing, due to that brother of informant died.

Submission of learned counsel for the petitioners is that though they are named in the FIR but no specific allegation has been attributed against any of them and there is case and

Heard learned APP and learned counsel for the informant. They have opposed the prayer for anticipatory bail stating that there is allegation against them that they fired and exploded bomb.

Having heard both sides and in the facts and circumstances, let petitioners, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-XIII, Saran at Chapra, in connection with Parsa P.S. Case No. 141 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioners shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
