Petitioner is in jail custody since 13.4.2016 in a case registered under sections 363 and 365 of the Indian Penal Code. Victim was recovered after the alleged occurrence and her statement was recorded under section 164 Cr.P.C in which she stated that two persons took her on a motorcycle and later on, she learnt about the names of the above stated persons and accordingly, victim disclosed the name of the petitioner.
Petitioner happens to be co- villager rather agnate of the informant.
Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate II, Hilsa, Nalanda in Hilsa P.S. Case no. 148/2016. shahid (Hemant Kumar Srivastava,J) U T
