The petitioner seeks bail in Bihra P.S. Case No. 108 of 2016 corresponding to Sessions Trial No. 110 of 2017, registered for the offence punishable under Sections 307, 323, 302 and other allied sections of the Indian Penal Code. Earlier the bail application of petitioner was rejected five times. This is sixth attempt.

Allegation against the petitioner is that he assaulted with Farsa on the head of informant's husband, as a result of which he died.

From perusal of para 9 of the petition, it appears that all the prosecution witnesses have already been examined and the case is pending for recording statement under Section 313 of

Patna High Court CR. MISC. No.17255 of 2021(2) dt.07-07-2021 2/2 the Cr.P.C.

Considering the nature of allegation and the stage of trial, I am not inclined to enlarge the petitioner above-named on bail.

As the petitioner is in custody since 08.09.2017, the trial court is directed to conclude the trial as early as possible. (Prabhat Kumar Singh, J) vinita/- U T
