This application, for grant of anticipatory bail, arises out of Rajauli Police Station Case No. 266 of 2017, disclosing offences under Sections 147, 148, 149, 353, 506 of the Indian Penal Code.

The allegation against the petitioner is that the petitioner, along with other co-accused persons, obstructed the Anchal Amin in the measurement of disputed land allegedly owned by one Asha Sinha.

Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case inasmuch as no overt act or any specific allegation has been levelled against the petitioner and the petitioner, being a lady, has been made

He further submits that similarly situated co-accused persons have been granted anticipatory bail by a co-ordinate Bench of this Court by order dated 20.12.2018, passed in Criminal Misc. No. 73337 of 2018.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that no specific allegation has been levelled against the petitioner and the petitioner is a lady, I am inclined to grant the petitioner privilege of anticipatory bail.

This application is, accordingly, allowed.

Let the petitioner, above named, in the event of her arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Rajauli Police Station Case No. 266 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
