JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-02-2020 Heard learned counsel for the petitioner and the State. Learned counsel for the petitioner submits that in terms of the statutory scheme and the judgment of the Apex Court in (2013) 10 SCC 772 respondents are obliged to consider the claim of the petitioner on the reserve category post after verification of the relevant documents.

Considering the aforesaid submission, the writ petition is disposed of with a direction to the Principal Secretary, Education Department to get the claim of the petitioner verified and examined in the light of judgment of the Apex Court (2013) 10 SCC 772 and Section 33 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995. Necessary decision in this regard must be taken at the earliest preferably within a maximum period of 60 days from the date of the receipt/production of a copy of this
