JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-08-2021 Heard the learned counsel for the petitioner and the learned APP for the State The petitioner seeks bail in anticipation of his arrest in connection with Shahkund P.S. Case No. 200 of 2019 instituted for the offence under Section 376 of the Indian Penal Code.

The prayer for anticipatory bail of the petitioner was earlier rejected by this Court vide order dated 25.06.2020 passed in Cr. Misc. No. 87821 of 2019. After some argument, learned counsel for the petitioner seeks permission to withdraw this application to enable the petitioner to surrender before the court below and

Patna High Court CR. MISC. No.16594 of 2021(2) dt.04-08-2021 2/2 seek bail.

Should the petitioner do so, his application shall be considered on its on merits, without being prejudiced by the fact that his prayer for anticipatory bail was earlier rejected and this application has not been entertained. The application is dismissed as withdrawn with the liberty aforesaid.
