The petitioner is languishing in custody since 17.12.2018 in a case registered for the offences punishable under Sections 30(a) and 37(b) of the Bihar Prohibition and Excise Act, 2016. The prosecution case, as per self statement of Sudeh Kumar, S.H.O., Sandesh Police Station, recorded on 16.12.2018 is to the effect that on the same day at about 5 P.M., the informant received an information that the petitioner has stored country made liquor in his house and is selling the same, whereupon raid was laid when one persons, who was fleeing away on a motorcycle, was apprehended. From the plastic container tied with the motorcycle, 30 litres of Mahua liquor were recovered and from the court yard of the petitioner 40

It is submitted by learned counsel for the petitioner that recovery has been made from the joint family house of the petitioner. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent. Learned APP submits that recovery has been made from the possession of the petitioner.

Considering the quantity of recovery and period under custody, coupled with the statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned CJM, Bhojpur, Arrah in connection with Sandesh P.S.
