The petitioner has preferred this application for grant of regular bail in a case registered under sections 386, 387, 504, 506 and 120B of the Indian Penal Code and section 27 of the Arms Act.

As per allegation in the F.I.R., six accused persons are stated to have come to the shop of the informant and demanded rangdari of Rs.1 lakh. It is stated that amongst the accused, the informant identified the son of Nepali Singh as also one Pintu Ram. He did not identify three others. He further states that Gulab Sharma and son of Nepali Singh were carrying pistol.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.16956 of 2021(2) dt.26-08-2021 2/2 that the petitioner is not named in the F.I.R. His name transpired in course of investigation. Neither any incriminating article has been recovered from his possession nor has he been put on T.I. parade inspite of being in custody since 8.8.2019. Investigation in the case has concluded. There is no other material against him except the confessional statement of co-accused Gulab Sharma made before police. His case stands on a similar footing to that of co-accused Amit Kumar who has been enlarged on bail vide order dated 4.2.2020 (Annexure-2).

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner having been in custody since 8.8.2019, the Court directs the petitioner to be enlarged on bail in connection with Naubatpur P.S. Case no.433 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Danapur, Patna.
