Petitioners seek bail in Punpun P.S. Case No.262 of 2019, registered for the offences punishable under Sections 302, 120(B) and 34 of the Indian Penal Code.

The allegation against the petitioners is that when the son of the informant went to meet his girlfriend (daughter of the petitioners), the petitioners along with others killed the son of the informant.

Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the

Patna High Court CR. MISC. No.16701 of 2021(3) dt.22-10-2021 2/2 present case. There is no eye witness of the occurrence of murder of the son of the informant. Only suspicion is there against the petitioners. Petitioners are in custody since 13.05.2020 and similarly situated other co-accused persons have been granted bail by different co-ordinate Benches of this Court by order dated 28.02.2020, passed in Cr. Misc. No.11085 of 2020 and order dated 29.02.2020, passed in Cr. Misc. No.13744 of 2020. It is lastly submitted that the petitioners have got no criminal antecedent as stated in paragraph 3 of the bail petition. Having considered the fact that similarly situated other co-accused persons have already been granted bail, let petitioners, above named, be released on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Masaurhi (Patna) in connection with Punpun P.S.
