JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Baghaila P.S. Case No. 22 of 2018, registered for the offences punishable under Sections 363 and 365 of the Indian Penal Code.
Allegation is of kidnapping of minor daughter of the informant and petitioner is not named in the FIR. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case as he happens to be brother of main accused Raju Gupta and the victim girl in her statement under Section 164 Cr.P.C. has not named this petitioner, which is Annexure-1 to the supplementary affidavit.. Heard learned APP and learned counsel for the informant, who has opposed the prayer for anticipatory bail of
Patna High Court CR. MISC. No.8347 of 2019(3) dt.23-04-2019 2/2 the petitioner stating that the victim girl is minor. Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Baghaila P.S.Case No. 22 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
