JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, one co-accused was arrested and disclosed the involvement of the petitioner in this case in his confessional statement. One Apache motorcycle was recovered from the house of the petitioner.
Learned counsel for the petitioner submits that coaccused Binod Rathore and some others, having similar allegation, have already been granted privilege of bail and so far as recovery of aforesaid Apache motorcycle is concerned, the same belongs to the brother of the petitioner and, moreover, the informant has not disclosed the registration number of the motorcycle which has

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of the aforesaid fact that petitioner does not have any criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Araria, Dist-Araria in connection with Forbesganj P.S.Case No. 691 of 2015, Session trial not 239 of 2016.
