JUSTICE SHIVAJI PANDEY ORAL ORDER 01-06-2016 Heard the counsel for the petitioner as well as counsel for the State.

In this case, the petitioner is seeking regular bail in connection with Special Case No. 01 of 2016 arising out of Saharsa Sadar P.S. Case No. 212 of 2016, registered for the offences punishable under Sections 20 and 22 of N.D.P.S. Act. Allegation has been made that the police who have been deputed in connection with matriculation examination have received secret information that some anti-social elements are indulged in selling of psychotropic goods. The police raided there and 5 Kg of Ganja was recovered in front of the shop. The same was kept over the cot.

The counsel or the petitioner submits that all the four persons are daily wages labourers and came there for finding out job and they have nothing to do with the plastic bag and have been wrongly implicated in this case. He further submits that it was the

Patna High Court Cr.Misc. No.24276 of 2016 (2) dt.01-06-2016 2/2 cot of Sukumar Yadav from where the alleged 4 Kg Ganja was recovered. The petitioner is having no criminal antecedent and he is suffering in custody since 17.03.2016.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge, Saharsa, in connection with Special Case No. 01 of 2016 arising out of Saharsa Sadar P.S. Case No.212 of 2016 subject to the conditions that:- (i) one of the bailors will be a close relative of the petitioner;

(ii) if the petitioner is found involved in similar type of case in future, the prosecution will be at liberty to make prayer for cancellation of his bail and the Court below will pass necessary order, including cancellation of bail and;

(iii) that the petitioner would participate in the court proceeding and in the event of being absent on two consecutive dates without reasonable explanation, the court below will be at liberty to cancel the bail bonds of the petitioner. (Shivaji Pandey, J) Mishra/- U T
