JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-04-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 302/201/120B of the Indian Penal Code.

As per the prosecution case, the petitioner along with other accused persons killed his father Naemuddin in order to prevent him from further transferring his properties in favour of sons of the informant/ second wife and buried the dead body inside the house itself.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case by the informant who happens to be the step mother of the petitioner and there is land dispute between the parties. There is no eye witness of the occurrence. Moreover, petitioner is

Learned counsel appearing for the State opposes the prayer for bail. He submits that the offence has been committed by the petitioner and other accused persons over a dispute regarding partition between sons of two wives of the deceased. Offence has been committed by the accused persons in the fore corners of the house and the dead body was found buried inside their house. Further for 8 days the accused persons did not lodge any complain regarding missing of the deceased. Considering the rival submissions of the parties and the fact that the dead body was recovered buried in the house of the petitioner, prayer for bail of the petitioner is refused.
