The petitioner seeks bail in a criminal prosecution registered under Section 372/34 of the Indian Penal Code. Though, the petitioner, besides others, is named in the FIR vide Annexure-1 as an accused, but taking into consideration the fact that the alleged victim Dolly Kumari, daughter of the informant, was recovered and her statement under Section 164 Cr.P.C. was recorded on 5th February, 2016 (Annexure-2) wherein she has given complete go-by to the entire prosecution version and has asserted that she has voluntarily solemnized her marriage with one Mukesh Chauhan and she has been blessed with child and also taking into consideration the fact that the petitioner is in judicial custody since 07.06.2015 and he is said to be the first offender, let the petitioner above named be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VIII, Patna in connection with Parsa Bazar P.S. Case No.65 of 2013 (Session Trial No.123A/2015).
