The petitioners are in custody in connection with Bind P.S. Case No. 128 of 2019 registered for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 and Sections 25(1-b)a/26/35 of the Arms Act.
In the instant case there is recovery of 1.5 litres of liquor and two country made pistol.
Learned counsel appearing on behalf of the petitioners would submit that the petitioners are father and son who are in custody since 04.11.2019 and 14.11.2019 respectively.
Patna High Court CR. MISC. No.7596 of 2020(3) dt.13-05-2020 2/2 Considering the fact that the petitioners are in custody for nearly six months, the Court is inclined to grant bail to the petitioners. Let the petitioners, above named, be released on bail on furnishing his personal bond to the satisfaction of the District and Sessions Judge-III-cum-Special Judge, Excise Act, Nalanda at Biharsharif in connection with Bind P.S. Case No. 128 of 2019, on account of the circumstances prevailing due to lockdown in the wake of Covid-19 pandemic.
