Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 07-01-2022 Heard the learned counsel for the petitioners and the learned APP for the State.

The petitioners seek bail in anticipation of their arrest in connection with Garkha P.S. Case No. 543 of 2020 instituted for the offences under Sections 341, 447, 448, 323, 307, 379, 504 and 34 of the Indian Penal Code. The informant is the full brother of the petitioner

Patna High Court CR. MISC. No.16579 of 2021(2) dt.07-01-2022 2/3 no. 3. The petitioner no. 1 and 2 are the wife and daughter respectively of petitioner no. 3.

The learned counsel for the petitioners has submitted that five persons have been made accused in this case including the petitioners with the accusation of assaulting the family members of the informant. There is a counter version of the occurrence also vide Garkha P.S. Case No. 546 of 2020 lodged by the petitioner no. 1 against the informant and others. Four persons who are said to have injured in the occurrence, have received simple injuries.

A Title Suit between the parties is also pending. Regard being had to the relationship between the parties, the background facts and the injuries suffered by the victims being simple in nature, the petitioners, above named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like
