The petitioners seek bail in a case under Section 302 and other sections of the Indian Penal Code.

The informant is not an eye witness of the occurrence. The informant named the petitioners along with other accused persons and alleged that the husband of Sulekha Devi was killed in which he and his brother, the deceased, were accused but they were acquitted. Sulekha Devi was always giving threatening to the informant and his brother to take revenge. The informant suspected that Sulekha Devi with the help of his men including the petitioner killed his brother.

It is submitted that Sulekha Devi and Shivdat Mallick

Patna High Court Cr.Misc. No.40732 of 2015 (2) dt.08-09-2015 2/2 have already been enlarged on bail vide order passed in Cr. Misc. No. 14203 of 2015 and the case of petitioners stands on the same footing.

Considering the facts aforesaid and the nature of allegation made against the petitioners, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in Singheshwar P.S. Case No. 197 of 2014.
