The petitioner seeks regular bail in connection with Gardanibagh P.S. Case No. 452 of 2018 registered for the offence punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act.

The allegation is regarding recovery of one pistol and two live cartridges from the dickey of the scooty of the petitioner.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is submitted that the petitioner has a clean antecedent and he is languishing in custody since 06.10.2018.

Having regard to the nature of the offence as alleged, I

No.7002 of 2019(2) dt.06-02-2019 2/2 deem it fit and proper to direct for release of the petitioner immediately upon completion of six months' custody i.e. with effect from 06.10.2018 subject to such conditions as may be imposed by the learned Sub-Judge-XIV-cum-A.C.J.M., Patna in connection with Gardanibagh P.S. Case No. 452 of 2018. The bail petition stands disposed off.
