JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 24.06.2014 in a case registered for the offences punishable under Sections 395, 397 of the Indian Penal Code.

In course of investigation, the name of petitioner surfaced and it came to light that petitioner was driver of the car which had been used in committing the alleged crime. Moreover, neither anything has been recovered from conscious possession of the petitioner nor he was put on Test Identification Parade. Petitioner does have clean antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.34175 of 2014 (3) dt.23-01-2015 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Khagaria (Muffasil) P.S. Case No. 270 of 2014.
