JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2020 Petitioners seek bail in connection with Excise Case No. 1438 of 2019 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act. Prosecution case is of recovery of 34.5 litres of liquor from the petitioners.
Submission of learned counsel for the petitioners is that recovery has not been made from their possession, rather from beneath the seat of bus and they have no criminal antecedent and they are in custody for more than one month and they are ready to co-operate in investigation. Heard learned APP also.
In view of above facts and circumstances, let
Patna High Court CR. MISC. No.5434 of 2020(2) dt.31-01-2020 2/2 petitioners be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-VII-cum-Special Judge, Excise, Aurangabad, in connection with Excise Case No. 1438 of 2019, subject to the condition that they have to co-operate in the investigation, otherwise their bail bonds shall be cancelled.
