The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code.

As per allegations in the FIR, the 14 named accused persons including the petitioner herein abused and assaulted the informant and his sons as a result of which Akhilesh Sah was referred to the PMCH, Patna.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The allegations are general and omnibus in nature. The injury reports have been brought on record as Annexure 2 series to the petition. A number of co-accused have been enlarged on

Patna High Court CR. MISC. No.17459 of 2021(2) dt.02-09-2021 2/2 anticipatory bail which would be evident from Annexure-3 to the petition. The petitioner is in custody since 20.10.2020 and there is no explanation for the delay of more than one month in lodging of the FIR.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case together with the petitioner having remained in custody for more than 10 months, the Court directs the petitioner to be enlarged on bail in connection with Chanpatia P.S. Case no. 233 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran.
