2. The present writ petition has been preferred for the following relief(s):

"I) A Writ in the nature of mandamus be issued commanding the respondents authorities to give the compensation amount to the petitioner for the acquisition his lands at the present market rate considering the commercial use of the land so acquired.

II) A further Writ in the nature of mandamus be issued directing the respondentsauthorities to return the land bearing Plot No.3973 and 3975 located in Mouza Bajidpur-Bamaiya as the same have not been utilised and alternatively in case of otherwise, the petitioner be given compensation at the present market rate in view of commercial importance of the land.

Patna High Court CWJC No.11908 of 2017(2) dt.28-04-2025 2/2 III) A further Writ in the nature of mandamus be issued directing the respondentsauthorities as to without acquiring the land of Plot No. 3976 and part of Plot No. 8378 are being used which is quite illegal and the same be acquired and the compensation amount of the commercial rate be given to the petitioner as the petitioner being the owner of the said land.

IV) Any other Writ, order/orders and/or direction be given to which the petitioner being found entitled in the eye of law by this Hon'ble Court."

3. At this stage, learned counsel for the petitioner submits that the sole petitioner died and he may be granted liberty to file a fresh petition through the heirs if they so want and/or in alternative, they may be allowed to approach the concerned respondent for the redressal of the grievance.

4. Granting said liberty, the writ petition stands disposed of.
